INSTRUCTIONS TO FOLLOW IN CASE OF ACCIDENT

By Luggage:

  • In the event of theft, a copy of the report filed with the local police or authorities will be provided, detailing the circumstances that occurred.
  • In the event of damage or loss caused by the carrier, a certificate issued by the Transport Company must be provided, stating the events that occurred.

For trip cancellation:

IN THE EVENT OF TRIP CANCELLATION, you must notify the Agency where you purchased the trip covered by the Policy at the time of the incident and notify the INSURER at most seven days from the occurrence of the incident.

For Vacation Refund:

You must notify the INSURER within a period of no more than seven days, providing all the data and supporting documents required.

SUMMARY OF THE GENERAL CONDITIONS OF THE POLICY

Of all the guarantees listed in the General Policy Conditions, the Insured is covered by those reflected in this summary. The Insured declares that he or she is aware of and has read the General Policy Conditions, expressly accepting the exclusions and limiting clauses highlighted therein.

WARRANTIES (SUMMARIZED)

1. LUGGAGE

1.1. Loss of materials.

The INSURER guarantees, up to the amount set out in the Specific Conditions, and subject to the exclusions indicated in these General Conditions, the payment of compensation for material losses suffered by luggage, during trips and stays outside the INSURED's habitual residence, as a result of:

  • Theft (for these purposes, theft is understood to mean only the theft committed by means of violence or intimidation of persons or force against things).
  • Breakdowns or damages caused directly by fire or theft.
  • Breakdowns and permanent loss, total or partial, caused by the carrier.

For stays of more than 90 consecutive days away from your usual residence, luggage is only guaranteed for round-trip travel to Spain.

Valuables are covered up to 50% of the insured amount for all luggage. Valuables include jewelry, watches, precious metal objects, furs, paintings, works of art, silver and precious metal jewelry, unique objects, mobile phones and their accessories, cameras and accessories for photography and video, radios, sound or image recording or reproduction, and their accessories, computer equipment of all kinds, remote-controlled models and accessories, rifles, hunting shotguns, and their optical accessories, wheelchairs and medical devices, etc.

Jewelry and furs are only guaranteed against theft and only when they are deposited in a hotel safe or carried by the INSURED.

Luggage left in motor vehicles is considered insured only if it is in the trunk and remains locked. From 22 p.m. to 6 a.m., the vehicle must remain in a closed and guarded parking lot; vehicles entrusted to a carrier are exempt from this limitation. Theft of luggage stored in vans is not covered under any circumstances, as these do not have independently lockable trunks.

Valuables left inside the trunk of a vehicle are only covered when the vehicle is in a secure garage or parking lot.

The application of the proportional rule in the event of a loss under this guarantee is expressly repealed, and the first risk is liquidated.

1.2.Delay in delivery.

Likewise, the insurance covers, upon presentation of an invoice, the purchase of necessary items, duly justified, caused by a delay of 24 hours or more in the delivery of checked baggage, regardless of the cause. In the event that the delay occurs on the return trip, the insurance will only cover baggage delivery for more than 48 hours from the date of arrival.

In no case can this compensation be accumulated to the base insurance compensation (1.1 Material losses).

EXCLUSIONS

Not covered by this warranty:

a) Goods and materials for professional use, coins, banknotes, travel tickets, stamp collections, securities of any kind, identity documents, and in general all paper documents and securities, credit cards, memory tapes and/or disks, documents recorded on magnetic strips or filmed, professional collections and materials, prostheses, glasses, and contact lenses. For these purposes, personal computers are not considered professional material.

b) Theft, except inside hotel or apartment rooms when they are locked. (For these purposes, theft is understood to be any theft committed carelessly, without the use of violence or intimidation of persons or force against things.)

c) Damage due to normal or natural wear and tear, inherent defects, and inadequate or insufficient packaging. Damage caused by the slow action of the elements.

d) Losses resulting from an object, not entrusted to a carrier, having simply been lost or forgotten.

e) Theft resulting from camping or caravanning in free camping, with valuables being completely excluded in any type of camping.

f) Damage, loss or theft resulting from personal effects and belongings being left unattended in a public place or in premises made available to several occupants.

g) Breakage, unless caused by an accident involving the means of transport, by simple or broken robbery, by armed assault, by fire or by extinguishing a fire.

h) Damage caused directly or indirectly by acts of war, civil or military unrest, popular uprisings, strikes, earthquakes and radioactivity.

i) Damage caused intentionally by the INSURED, or due to gross negligence on the part of the INSURED, and damage caused by spillage of liquids inside the luggage.

j) All motor vehicles, as well as their accessories and complements.

2. DELAYS

The maximum compensation in the event of a claim for this coverage will be €20.000,00, regardless of the number of passengers affected.

2.7. Alternative transport due to loss of connection.

If public transport is delayed or cancelled and as a result the INSURED is unable to connect with the next scheduled public transport service provided for in the ticket, the INSURER will reimburse, up to the limit established in the Specific Conditions, the costs of return transport to the place of origin or the costs of alternative transport to the final destination.

2.8 Loss of contracted services.

If, as a result of illness of the INSURED, justified by a medical report, delay or cancellation of public transport due to technical failure, strike or social conflict, inclement weather, natural disasters, extraordinary natural phenomena, intervention by the authorities or other persons by force, the INSURED loses part of the services initially contracted and included in the initial reservation of the trip, such as, other than the transport tickets planned for the realization of said trip, such as excursions, countries to be visited, accommodation, meals or any other similar service, the INSURER will reimburse the cost of this loss up to the limit established in the Specific Conditions.

2.10 Compensation for services.

If, once the trip has begun and as a result of delays or cancellation of the scheduled means of transport, due to breakdown of the same, adverse weather conditions or force majeure, duly accredited, the INSURED loses part of the services initially contracted or is forced to pay expenses for unforeseen services not included in the trip, provided that said expenses are reasonable, proportionate and a direct consequence of the impossibility of continuing the trip as planned, the INSURER will reimburse the cost of the lost services or the amount of the extra expenses generated by the contracting of unforeseen services, up to the limit established in the Specific Conditions, upon presentation of the corresponding invoices or supporting documents.

For the purposes of the provisions of the preceding paragraph, force majeure shall only be understood to mean any unforeseen, external, uncontrolled circumstance beyond the insured's control and impossible to avoid, which occurs during the course of the trip and is not attributable to the organizer of the trip.

This guarantee will only apply, as indicated in the first paragraph, if the contracted trip has already begun. It will not apply to cases of total cancellation by the INSURED, in which case the provisions of the "Trip cancellation expenses" guarantee will apply.

EXCLUSIONS

Not covered by this warranty:

a) Strikes and social conflicts. This exclusion will not apply to guarantees 2.2 cancellation of departure of the means of transport due to strike and 2.3 Loss of connections due to delay of the means of transport.

b) Accidents occurring in cases of terrorism, declared or undeclared wars (civil or foreign), demonstrations and popular movements, uprisings, riots, civil commotion and sabotage.

c) Accidents caused by radiation from nuclear transmutation or disintegration or radioactivity, as well as those resulting from biological or chemical agents. 

4. ASSISTANCE

24-hour permanent service for assistance to persons that the INSURER makes available to the INSURED.

1. Healthcare assistance is expressly included as a result of accidents occurring during scuba diving.

The Contractor must provide passenger lists before the start of each trip, indicating the dates of the trip and the destination where the diving will take place.

2. If, as a result of diving, the Insured suffers an accident or a search is necessary and, given the seriousness of the case, the use of a helicopter is necessary, the Insurer will cover the cost of the same, upon presentation of the corresponding invoices covered within the transfer and repatriation guarantee, with a limit of €3.000,00 for RESCUE EXPENSES.

4.1 Medical, surgical, pharmaceutical and hospitalization expenses.

The INSURER shall be responsible, up to the limit established in the Specific Conditions, for any medical-surgical, pharmaceutical, hospitalization and ambulance expenses required by the INSURED during the trip, as a result of an illness or accident occurring during the trip.

In cases of life-threatening emergency due to an unforeseen complication of a chronic or pre-existing illness, only the costs of initial emergency medical care provided within the first 24 hours of the start of care at the medical center or hospital will be covered.

In the event of theft of luggage containing medication that the INSURED is using for the treatment of his or her chronic or pre-existing illness, the INSURER will cover, up to a maximum of €150,00, the costs of an initial medical visit to obtain the prescription.

In any case, dental expenses are limited to €150, and this covers dental expenses requiring emergency treatment (treatments, extractions, oral cleanings, and conventional simple radiology), due to the appearance of acute problems, such as infections, pain, trauma, or as a result of an accident (emergency dental treatment that must be applied to natural teeth).

If this policy was purchased for travel recipients and so indicated in the Specific Conditions, the limits cited in the medical expenses coverage will be applied in reverse.

4.1.1. Health Services.

In the event of a health problem occurring during the term of the policy, the INSURED will have the following services available to them and may request them:

4.1.1.a) A Second Medical Opinion, which allows the Insured to access the observations and recommendations of specialists, with extensive experience in their respective areas of training, regarding their medical diagnosis and treatment options.

The Insured may request this Second Medical Opinion service for a serious medical problem, an unexpected relapse of a serious illness (which has not been treated or for which medical care has not been received during the 30 days prior to taking out the insurance) or a serious accident, occurring during the period from 60 days prior to the planned travel date - and, in any case, after taking out the insurance - until the end of the policy term.

The Insured may request a Second Medical Opinion service for the medical conditions described above up to six months after the policy expires. In all cases, the corresponding medical reports must be provided.

4.1.1.b) A Specialist Reference and Coordination of Medical Travel, which will allow the Insured to benefit from the identification of specialists with recognized experience in the diagnosis and treatment of their illness, as well as a logistical support and medical follow-up service.

The Insured may request this Specialist Referral service for a serious medical problem, an unexpected relapse of a serious illness (which has not been treated or for which medical care has not been received during the 30 days prior to taking out the insurance) or a serious accident, occurring during the period from 60 days prior to the planned travel date - and, in any case, after taking out the insurance - until the end of the policy term.

The Insured may request the Specialist Referral service for the medical problems described above up to 6 months after the end of the policy term.

Additionally, the Insured is provided with a team of professionals who will coordinate travel for scheduled medical treatments, should they need to travel outside their province of residence.

In any case, the corresponding medical reports must be provided, and no medical, travel, or accommodation expenses will be assumed.

The pathologies covered by the Second Medical Opinion and Specialist Referral services will be the following:

  • Cancer.
  • Degenerative neurological diseases (Parkinson's, Alzheimer's), demyelinating (Multiple Sclerosis), neuromuscular (dystrophies, myasthenia gravis) and cerebrovascular diseases.
  • Neurosurgical diseases (tumors, malformations and intracranial aneurysms).
  • Cardiovascular surgery (by-pass, aortic aneurysms, valve surgery and cardiac malformations).
  • Chronic renal insufficiency.
  • Ophthalmological diseases that cause vision loss greater than 50%.
  • Musculoskeletal diseases that present with chronic, long-term pain or that severely affect the patient's ability to perform daily and/or work activities.
  • Transplantation of vital organs.

4.2 Expenses for extending a hotel stay.

If the INSURED falls ill or has an accident and cannot return on the scheduled date, when the INSURER's medical team decides so based on their contacts with the attending physician, the INSURER will cover any expenses not initially foreseen by the INSURED, due to the extension of the stay at the hotel by a maximum of 10 days and up to the total and daily limits stated in the Specific Conditions.

4.3 Repatriation or medical transport of injured or sick persons.

In the event of an accident or illness occurring to the INSURED, the INSURER will be responsible for transportation to a hospital that has the necessary facilities, or to the INSURED's home.

Likewise, the INSURER's medical team, in contact with the physician treating the INSURED, will oversee that the care provided is appropriate.

If the INSURED is admitted to a hospital far from his or her usual residence, the INSURER will take care of the transfer home as soon as possible.

The means of transport used in each case will be decided by the INSURER's medical team based on the urgency and severity of the condition. When the patient is in a hospital with adequate infrastructure to satisfactorily treat the INSURED'S medical problem, medical transport may be postponed long enough for the severity of the condition to subside, allowing for the transfer to be carried out in better medical condition. Exclusively in Europe and countries bordering the Mediterranean, specially equipped medical aircraft may even be used.

4.4 Repatriation or transportation of deceased.

In the event of the death of the INSURED, the INSURER will be responsible for the arrangements and costs of preparing and transporting the remains in a zinc coffin, or in an ash box if prior cremation of the deceased has been requested, from the place of death to the burial site in Spain. The INSURER will also be responsible for transporting the remaining insured persons who accompanied the INSURED to their respective homes in Spain, in the event that the INSURER's death makes it materially impossible for them to return by the means initially planned. Payment for the standard coffin and burial and ceremony costs are excluded from this coverage.

4.5 Travel of a companion in case of hospitalization.

If the INSURED has been hospitalized and the stay is expected to exceed three days, the INSURER will provide a return ticket from their home to a family member to be admitted to their hospital. This period will be reduced to 3 hours in the case of minors or disabled persons, when they are unaccompanied by a family member or legal guardian.

4.6 Stay of the displaced companion.

In the event of hospitalization of the INSURED for more than 3 days, the INSURER will cover the hotel expenses of the displaced family member or, alternatively, the hotel expenses of the person traveling with the INSURED and also insured under this policy, to accompany the hospitalized INSURED, upon presentation of the appropriate supporting documents, up to a maximum of 10 days and up to the total and daily limits stated in the Specific Conditions. This period will be reduced to 48 hours in the case of minors or disabled persons, when they are not accompanied by a family member or their legal guardian.

4.7 Repatriation of a companion.

In the event that the INSURED, who is ill, has an accident, or dies, must be repatriated for any of the reasons set forth in sections 4.3 and 4.4, and is traveling with another insured, the INSURER will organize and pay for the companion's return with the INSURED to the latter's usual residence. Likewise, if the INSURED, who has an accident, or dies, is traveling with only one child, also INSURED, who is under 15 years of age or disabled, the INSURER will organize and pay for the travel of a person to accompany the latter on their return home.

4.9 Return of the Insured due to the death of an uninsured family member. 

In the event that the INSURED must interrupt the trip due to the death of a family member, the INSURER will cover transportation to the burial site in Spain and, where applicable, a return ticket to the place where the person was when the event occurred, or two return tickets in the case of another INSURED companion.

This coverage will also apply when the deceased person has any of the relationships indicated in the definition of RELATIVES with the spouse or partner of the INSURED.

4.10 Return of the INSURED due to hospitalization of an uninsured family member.

In the event that the INSURED must interrupt their trip due to the hospitalization of a family member as a result of an accident or serious illness requiring a minimum stay of 5 days, and the accident or illness occurs after the trip's start date, the INSURER will cover their transportation to their usual place of residence in Spain. The INSURER will also cover a second ticket for the transportation of the person accompanying the INSURED on their trip who anticipated their return, provided that this second person is also insured under this policy. This coverage will also apply when the hospitalized person is related to the INSURED's spouse or partner in any of the relationships indicated in the definition of RELATIVES.

4.13 Urgent shipment of medicines not available abroad.

If the INSURED, who is traveling abroad, has made use of the medical assistance guarantee indicated in point 4.1, the INSURER will be responsible for finding and sending the necessary medication by the fastest means, if it does not exist in the country where the assistance is provided.

4.14 Transmission of messages.

The INSURER will be responsible for transmitting urgent messages, as requested by the INSURED, arising from the events covered by these guarantees.

EXCLUSIONS

They are not covered by this warranty

a) Guarantees and benefits that have not been requested from the INSURER and that have not been carried out by or with its agreement, except in the case of force majeure or proven material impossibility.

b) Claims caused by the fraud of the INSURED, the INSURANCE POLICYHOLDER, the BENEFICIARIES or persons travelling with him/her, as well as any medical service or assistance requested by the INSURED, when it is proven that he/she made the trip for the purpose of being treated for his/her ailments at the destination, charged to the policy and the INSURER.

c) Claims occurring in the event of war, pandemics, demonstrations and popular movements, acts of terrorism and sabotage, strikes, arrests by any authority for a crime not arising from a traffic accident, restrictions on free movement or any other case of force majeure, unless the INSURED proves that the claim is not related to such events.

d) The practice of sports activities of groups B and C of the DEFINITIONS section.

e) The practice of sports activities in group D of the DEFINITIONS section.

f) Accidents caused by radiation from nuclear transmutation or disintegration or radioactivity, as well as those derived from biological or chemical agents.

g) Rescue in the mountains, sea or desert.

h) Except as indicated in point 4.1 of these Conditions, illnesses or injuries that occur as a result of chronic or pre-travel conditions, as well as their complications or relapses.

i) Illnesses and accidents occurring in the exercise of a manual profession or one that requires intense physical effort.

j) Suicide or illnesses and injuries resulting from the attempt or intentionally caused by the insured to himself.

k) Treatment or diseases or pathological conditions caused by ingestion or administration of toxins (drugs), alcohol, narcotics or by the use of medications without a medical prescription.

l) Expenses incurred on any type of prosthesis.

m) Births.

n) Pregnancies, except for unforeseen complications in the first 24 weeks of pregnancy. ñ) Periodic medical check-ups, whether preventive or pediatric.

o) Any type of medical or pharmaceutical expense resulting from fraud on the part of the INSURED, or from abandonment of treatment that makes deterioration of health foreseeable.

p) Endodontic, periodontal, orthodontic dentistry, fillings, dental prostheses, apicoectomies, implantology and the diagnostic means necessary to perform these treatments.

q) Transfer and/or repatriation by medical aircraft, except in Europe and countries bordering the Mediterranean.

With the express prior authorization of the INSURER and through an agreed premium, exclusions d) and i) may be eliminated, in whole or in part.

4.15 Assistance in locating and shipping luggage.

In the event of lost luggage, the INSURER will assist in the search and location process and will cover the costs of shipping it to the INSURED'S address.

7. CANCELLATION

7.1 Trip cancellation expenses.

The INSURER guarantees, up to the limit set out in the Specific Conditions, and subject to the exclusions mentioned in these General Conditions, the reimbursement of trip cancellation expenses incurred by the INSURED and billed to him/her in accordance with the general sales conditions of the Agency or any of the travel providers, provided that he/she cancels the trip before it begins for any of the reasons detailed below, occurring after the insurance was taken out and requiring the Insured to cancel or postpone the trip on the scheduled date.

For the purposes of this policy, the following shall be deemed to be included in this guarantee: management costs, cancellation costs, if any, and any penalties that may have been applied in accordance with the law or the conditions of the trip.

1. For health reasons:

1.1. Death, serious bodily injury or serious illness:

Of the INSURED or any person listed in the definition of RELATIVES. In the case of first-degree descendants under 24 months of age, their illness does not have to be considered serious.

This coverage will also apply when the hospitalized or deceased person is related to the INSURED's spouse, common-law partner, or other person who permanently lives with them. This coverage also applies to the person responsible for the INSURED's minor children or disabled relatives during the trip who are legally under their care. This coverage also applies to the INSURED's direct supervisor at their workplace, provided that this circumstance prevents them from making the trip due to requirements imposed by the company they work for.

In relation to the INSURED, a serious illness is understood to be a health condition that requires hospitalization or bed rest within 7 days prior to the trip, and which, medically speaking, makes it impossible to start the trip on the scheduled date or which, in the opinion of a medical professional, prevents the INSURED from diving on the dates of the trip.

A serious accident is understood to mean bodily harm, unintentional on the part of the victim, resulting from the sudden action of an external cause and which, in the opinion of a medical professional, makes it impossible for the INSURED to begin the trip on the scheduled date.

When the illness or accident affects any of the aforementioned persons, other than the INSURED, it will be understood as serious when it involves hospitalization or entails a risk of imminent death.

1.1. Medical quarantine as a result of an accidental event.

1.2. Call for surgery for the INSURED, provided that they were already on the waiting list at the time of purchasing both the trip and the insurance.

1.3. Call for urgent medical tests for the INSURED or a first-degree relative, carried out by the Public Health Service, provided they are justified by the severity of the case.

1.4. Appointment for an organ transplant for the INSURED or a first-degree relative, provided they were already on the waiting list at the time of purchasing both the trip and the insurance.

1.5. Need for bed rest for the INSURED, their spouse, common-law partner, or person who permanently lives with the INSURED, due to medical prescription as a result of a high-risk pregnancy, provided that this risk began after the policy was taken out.

1.6. Serious complications in the state of pregnancy that, by medical prescription, require bed rest or hospitalization of the INSURED, his or her spouse, common-law partner, or person who as such permanently lives with the INSURED, provided that said complications have occurred after the policy was taken out and seriously jeopardize the continuity or necessary development of said pregnancy.

1.7. Premature birth of the INSURED.

2. For legal reasons:

2.1. Summons, as a party, witness, or jury, to a Civil, Criminal, or Labor Court. Cases in which the insured is summoned as a suspect in proceedings initiated before the travel and insurance contract are excluded. For all other appearances, the summons must be issued after the travel and insurance contract is issued.

2.2. Call to serve as a member of a polling station for state, regional, or municipal elections.

2.3. Call for submission and signing of official documents.

2.4. Placement of a child for adoption that coincides with the planned travel dates.

2.5. Summons for divorce proceedings.

2.6. Unexpected non-granting of visas.

2.7. Police detention for non-criminal reasons.

2.8. Imposition of a traffic fine exceeding €600, provided that both the violation committed and the knowledge of the fine occurred after the reservation was booked.

2.9. Withdrawal of the driver's license. Provided that the vehicle will be used as a means of transportation for the trip and none of the INSURED'S companions can replace them in driving the vehicle.

3. For work reasons:

3.1. Professional, non-disciplinary dismissal of the INSURED.

They will be entitled to unemployment coverage when:

1) The termination of your employment contract had occurred after the policy was taken out and before the start of the trip due to any of the following circumstances:

a) By virtue of employment regulation or collective dismissal file.

b) Due to the death or incapacity of the individual entrepreneur and this being the cause that determines the termination of the employment contract.

c) For unfair dismissal.

d) Due to dismissal or termination of the contract based on objective causes.

2) Whenever at the time of communicating the termination of the work, payment of part of the installments of said financing is still pending,

3) Whenever the insured decides to continue with their trip and it has finally taken place.

The INSURER will pay the cost of the regular installments pending amortization, up to a maximum of 6 installments, in order to prevent the INSURED from being forced to cancel said trip.

The maximum amount to be paid by the INSURER will be 50% of the cost of the cancellation expenses that would have been generated if said trip had been canceled at the time of learning of the termination of the employment contract.

This coverage cannot be accumulated nor would it complement the trip cancellation guarantee. If the trip is canceled for any of the other reasons reflected in the policy conditions and compensation has already been paid for this coverage, the amount paid under this coverage will be deducted from the total amount of the cancellation expenses generated. coverage.

3.2. Submission of a redundancy plan that directly affects the insured as an employed person, resulting in a total or partial reduction in their working hours. This circumstance must occur after the insurance subscription date.

3.3. The INSURED'S incorporation into a new position, in a company other than the one where they last held their job, provided that the contract is signed and the incorporation takes place after the insurance has been taken out. This coverage will also be valid when the insured returns from unemployment.

3.4. Geographical relocation of the job, provided that it involves a change of address for the Insured during the planned dates of the trip and the Insured is an employed worker.

3.5. Participation in official competitive examinations, either as a candidate or as a member of the competitive examination board, scheduled and announced through a public body after the insurance has been purchased and which coincides with the travel dates.

3.6. Dismissal of the INSURED'S parents, provided that their trip was paid for by them.

3.7. Extension of employment contract.

When the accident is covered by any of the aforementioned work-related causes, in addition to the INSURED, the following will also be covered by this policy: their spouse, common-law partner, or person who permanently lives with the INSURED; and their minor children, also insured on the same trip, provided they reside at the same address as the INSURED.

4. For extraordinary reasons:

4.1. An act of air piracy that makes it impossible for the INSURED to begin their trip on the scheduled dates.

4.2. Declaration of a disaster area or epidemic at the INSURED's place of residence or at the travel destination.

4.3. Court declaration of suspension of payments or bankruptcy of the company in which the INSURED works.

4.4. Serious damage caused by fire, explosion, theft or force of nature, to your primary or secondary residence, or to your professional premises if the INSURED exercises a liberal profession or manages a company and your presence is absolutely necessary.

4.5. Request for urgent and inexcusable recruitment into the Armed Forces, Police, or Fire Department, provided that this must occur after the insurance has been purchased and the person was not aware of it at the time of making the reservation.

5. Other causes:

5.1. Request from the Tax Agency to file a supplementary income tax return, the final result of which requires the Insured to pay an additional amount exceeding €600.

5.2. Cancellation of the person who is to accompany the INSURED on the trip, registered at the same time as the INSURED and insured under this same contract, provided that the cancellation is due to one of the reasons listed above and, due to this, the INSURED must travel alone.

5.3. Breakdown or accident in the vehicle owned by the INSURED that makes it impossible for the INSURED to start the trip.

Notwithstanding the foregoing, and provided the INSURED does not cancel the trip, the INSURER will guarantee reimbursement of reasonable and justified vehicle rental expenses to continue the trip as originally planned. The maximum amount payable by the INSURER will be the lower of the following amounts:

a) 50% of the cost of the cancellation expenses that would have been generated if the trip had been cancelled at the time of the accident or breakdown, or

b) 50% of the insured amount of the trip cancellation guarantee.

This coverage cannot be cumulative or complementary to the trip cancellation guarantee.

If the trip is canceled for any of the other reasons reflected in the policy conditions, and compensation has already been paid for this coverage, the amount paid will be deducted from the total amount of the cancellation expenses generated. this coverage.

5.4. Theft of documentation or luggage that prevents the INSURED from starting the trip.

5.5. Cancellation of a wedding ceremony, provided that the insured trip was a honeymoon trip.

5.6. Obtaining a trip and/or stay similar to the one booked, free of charge, in a public lottery and before a notary.

5.7. Granting of official scholarships that prevent the trip from taking place.

5.8. Changing schools after the school year has already begun for the Insured or for children living with them.

In the event that, for any of the reasons set forth in this section on TRIP CANCELLATION EXPENSES, the INSURED transfers the reservation to another person, any additional expenses incurred due to the change of reservation holder will be covered.

Additional expenses borne by the INSURED for changes in date to postpone the trip will also be covered, provided they do not exceed the expenses incurred in the event of cancellation.

EXCLUSIONS

Cancellations due to:

a) Cosmetic treatments, periodic check-ups, cures, contraindications for air travel, vaccinations, the impossibility of following the recommended preventive medical treatment in certain destinations, voluntary termination of pregnancies.

b) Psychic, mental illnesses and depressions without hospitalization or that justify hospitalization of less than seven days.

c) Illnesses that are being treated or require medical care within the 30 days prior to both the date of booking the trip and the date of inclusion in the insurance, except as indicated in points 1.3 and 1.5.

d) In general, all cancellations that occur as a result of causes that occurred at the time of contracting the policy, known to the POLICYHOLDER and/or INSURED.

e) Participation in bets, duels, crimes, fights, except in cases of self-defense.

f) Terrorism.

g) Failure to present essential documents for any trip, such as passport, visas, tickets, ID cards or vaccination certificates.

h) Complications of the state of pregnancy, except as indicated in points 1.6, 1.7 and 1.8.

i) Accidents caused by radiation from nuclear transmutation or disintegration or radioactivity, as well as those derived from biological or chemical agents.

j) Pandemics.

8. VACATION REFUND

8.1 Holiday Refund.

The INSURER will reimburse the INSURED, up to the maximum amount set out in the Specific Conditions, and subject to the exclusions mentioned in these General Conditions, the cost of the services, contracted before the start of the trip and upon documentary proof of their cost, which could not be used as a result of the early conclusion of the scheduled trip, which necessarily entails the return of the INSURED to his/her usual place of residence, for any of the following reasons, occurring during the course of the trip:

a) Due to accident or illness of the INSURED.

b) For hospitalization of an uninsured family member, once the trip has begun, which requires a minimum stay of 24 hours.

c) Due to the death of the INSURED, during the trip, or of an uninsured family member.

d) For serious damage to the INSURED's home or professional office, occurring after the start date of the trip, caused by a fire that has led to the intervention of the fire brigade, explosion, theft completed and reported to the police authorities, or serious flooding that makes their presence essential.

For the purposes of this coverage, any of the persons listed in the definition of RELATIVES will be considered a relative of the INSURED. This coverage will also apply when the hospitalized or deceased person is related to the INSURED's spouse or partner in any of the same ways.

This coverage will also be extended to a companion of the INSURED during the trip, provided that the INSURED is also insured under this policy, in the event that the INSURED decides to end their trip early to accompany the INSURED on their return to their usual place of residence.

If a family is traveling, early return will be considered for all members, up to a maximum of four people. If the family includes minor children, two more will be included, up to a maximum of six people.

The refund amount will be obtained by dividing the total cost of the contracted services by the number of travel days established in the Specific Conditions of the policy and then multiplying the daily amount obtained through this calculation by the number of travel days lost.

In the case of cruise trips, hospitalization of the INSURED during the trip that prevents them from continuing will also be covered. If a family is traveling, accompanying family members will be included, up to a maximum of four people. If the family includes minor children, two more will be included, up to a maximum of six people.

The counting of lost travel days will be carried out from the day following the event that led to the interruption of the trip, except in cases of hospitalization of the INSURED or an uninsured family member, in which case it will be carried out from the day of their hospital admission.

If the amount of the contracted services exceeds the insured amount of this policy, the reimbursement will be calculated based on the amount resulting from dividing the insured amount by the number of days of the trip.

EXCLUSIONS

Not covered by this warranty:

a) Early returns that have not been communicated to the INSURER and that have not been carried out by or with its agreement, except in the case of force majeure or proven material impossibility.

b) Accidents caused by the fraud of the INSURED, the INSURANCE POLICYHOLDER, the BENEFICIARIES or the persons traveling with the INSURED.

c) Any refund requested in cases where the return of the INSURED occurred on the date scheduled for the completion of the trip or after the trip.

d) Illnesses or injuries that occur as a result of chronic or pre-travel conditions (except for the exacerbation or decompensation of a chronic illness during the trip) and AIDS in any of its stages.

e) Illnesses that are being treated or require medical care within the 30 days prior to both the date of booking the trip and the date of inclusion in the insurance.

f) Psychic, mental illnesses and depression without hospitalization or that justify hospitalization of less than seven days.

g) Illnesses or injuries arising in the exercise of a manual profession.

h) Suicide or illnesses and injuries resulting from the attempt or intentionally caused by the insured to himself.

i) Treatment or diseases or pathological conditions caused by ingestion or administration of toxins (drugs), alcohol, narcotics or by the use of medications without a medical prescription.

j) Births.

k) Pregnancies, except for unforeseen complications in the first 24 weeks of gestation.

l) Participation in bets, duels, crimes, fights, except in cases of self-defense.

m) Terrorism.

INSTRUCTIONS TO FOLLOW IN CASE OF ACCIDENT

By Luggage:

  • In the event of theft, a copy of the report filed with the local police or authorities will be provided, detailing the circumstances that occurred.

SUMMARY OF THE GENERAL CONDITIONS OF THE POLICY

GUARANTEE

1. 1. LUGGAGE

1.1 Material Losses.
The INSURER guarantees, up to the amount set out in the Specific Conditions, and subject to the exclusions indicated in these General Conditions, the payment of compensation for material losses suffered by luggage, during trips and stays outside the INSURED's habitual residence, as a result of:

• Theft (for these purposes, theft is understood to mean only the theft committed by means of violence or intimidation of persons or force against things).

• Breakdowns or damages caused directly by fire or theft.

• Breakdowns and permanent loss, total or partial, caused by the carrier.

For stays of more than 90 consecutive days away from your usual residence, luggage is only guaranteed for round-trip travel to Spain.

Valuables are covered up to 50% of the insured amount for all luggage. Valuables include jewelry, watches, precious metal objects, furs, paintings, works of art, silver and precious metal jewelry, unique objects, mobile phones and their accessories, cameras and accessories for photography and video, radios, sound or image recording or reproduction, and their accessories, computer equipment of all kinds, remote-controlled models and accessories, rifles, hunting shotguns, and their optical accessories, wheelchairs and medical devices, etc.

Jewelry and furs are only guaranteed against theft and only when they are deposited in a hotel safe or carried by the INSURED.

Luggage left in motor vehicles is considered insured only if it is in the trunk and remains locked. From 22 p.m. to 6 a.m., the vehicle must remain in a closed and guarded parking lot; vehicles entrusted to a carrier are exempt from this limitation. Theft of luggage stored in vans is not covered under any circumstances, as these do not have independently lockable trunks.

Valuables left inside the trunk of a vehicle are only covered when the vehicle is in a secure garage or parking lot.

The application of the proportional rule in the event of a loss under this guarantee is expressly repealed, and the first risk is liquidated.

EXCLUSIONS
Not covered by this warranty:

a) Goods and materials for professional use, coins, banknotes, travel tickets, stamp collections, securities of any kind, identity documents, and in general all paper documents and securities, credit cards, memory tapes and/or disks, documents recorded on magnetic strips or filmed, professional collections and materials, prostheses, glasses, and contact lenses. For these purposes, personal computers are not considered professional material.

b) Theft, except inside hotel or apartment rooms when they are locked. (For these purposes, theft is understood to be any theft committed carelessly, without the use of violence or intimidation of persons or force against things.)

c) Damage due to normal or natural wear and tear, inherent defects, and inadequate or insufficient packaging. Damage caused by the slow action of the elements.

d) Losses resulting from an object, not entrusted to a carrier, having simply been lost or forgotten.

e) Theft resulting from camping or caravanning in free camping, with valuables being completely excluded in any type of camping.

f) Damage, loss or theft resulting from personal effects and belongings being left unattended in a public place or in premises made available to several occupants.

g) Breakage, unless caused by an accident involving the means of transport, by simple or broken robbery, by armed assault, by fire or by extinguishing a fire.

h) Damage caused directly or indirectly by acts of war, civil or military unrest, popular uprisings, strikes, earthquakes and radioactivity.

i) Damage caused intentionally by the INSURED, or due to gross negligence on the part of the INSURED, and damage caused by spillage of liquids inside the luggage.

j) All motor vehicles, as well as their accessories and complements.

7. CANCELLATION AND REFUND OF HOLIDAYS

7.1 Trip cancellation expenses. 

The INSURER guarantees, up to the amount set out in the Specific Conditions, and subject to the exclusions mentioned in these General Conditions, the reimbursement of trip cancellation expenses incurred by the INSURED and billed to him/her in accordance with the general sales conditions of the Agency or any of the travel providers, provided that he/she cancels the trip before it begins and for one of the following reasons that occur after the insurance has been taken out:

a) Death, serious bodily injury or serious illness:

Of the INSURED or any person listed in the definition of RELATIVES. In the case of first-degree descendants under 24 months of age, their illness does not have to be considered serious.

This coverage will also apply when the hospitalized or deceased person is related to the INSURED's spouse, common-law partner, or other person who permanently lives with them. This coverage also applies to the person responsible for the INSURED's minor children or disabled relatives during the trip who are legally under their care. This coverage also applies to the INSURED's direct supervisor at their workplace, provided that this circumstance prevents them from making the trip due to requirements imposed by the company they work for.

In relation to the INSURED, a serious illness is understood to be a health condition that requires hospitalization or bed rest within 7 days prior to the trip, and which, medically speaking, makes it impossible to start the trip on the scheduled date or which, in the opinion of a medical professional, prevents the INSURED from diving on the dates of the trip.

A serious accident is understood to mean bodily harm, unintentional on the part of the victim, resulting from the sudden action of an external cause and which, in the opinion of a medical professional, makes it impossible for the INSURED to begin the trip on the scheduled date.

When the illness affects any of the aforementioned persons, other than the INSURED, it will be considered serious when it requires hospitalization or carries a risk of imminent death.

A serious accident is understood to mean unintentional bodily harm to the victim, resulting from the sudden action of an external cause and which, in the opinion of a medical professional, makes it impossible for the INSURED to begin the trip on the scheduled date, or entails a risk of death for any of the aforementioned family members.

b) Summons, as a party, witness or jury of a Civil or Criminal Court.

c) Call as a member of an electoral table, for state, autonomous or municipal elections.

d) Submission to official competitive examinations announced through a public body after taking out the insurance.

e) Serious damage caused by fire, explosion, theft or by force of nature, in his/her main or secondary residence, or in his/her professional premises if the INSURED exercises a liberal profession or manages a company and his/her presence is imperatively necessary.

f) Professional dismissal of the INSURED, not disciplinary.

g) Incorporation into a new job, in a company other than the one where the job was performed, with an employment contract and provided that the incorporation takes place after the trip registration and, therefore, the subscription of the Insurance.

h) Income tax return filed in parallel by the Ministry of Economy and Finance, resulting in an amount payable by the INSURED exceeding €600.

i) An act of air piracy that makes it impossible for the INSURED to begin their trip on the scheduled dates.

j) Declaration of a disaster area or epidemic at the INSURED's place of residence or at the travel destination.

k) Medical quarantine as a result of an accidental event.

l) Call for surgical intervention of the INSURED, as well as the medical tests prior to said intervention.

m) Call for medical tests of the INSURED or first-degree relative, carried out by the Public Health Service on an urgent basis, provided that they are justified by the seriousness of the case.

n) Need for bed rest of the INSURED, his/her spouse, or common-law partner registered as such in an official, local, regional or national Registry, due to medical prescription as a result of a high-risk pregnancy, provided that this risk began after the policy was taken out.

o) Serious complications in the state of pregnancy that, by medical prescription, require rest or hospitalization of the INSURED, his/her spouse, or common-law partner registered as such in an official Registry, local, regional or national, provided that said complications have occurred after the policy was taken out and seriously jeopardize the continuity or necessary development of said pregnancy.

p) Premature birth of the INSURED.

q) Cancellation of the person who is to accompany the INSURED on the trip, registered at the same time as the INSURED and insured by this same contract, provided that the cancellation is due to one of the causes listed above and, due to this, the INSURED must travel alone.

In the event that, for any of the reasons set forth in this section on TRIP CANCELLATION EXPENSES, the INSURED transfers the reservation to another person, any additional expenses incurred due to the change of reservation holder will be covered.

This guarantee will only be valid if it has been subscribed to at the time of registration or confirmation of the trip.

Cancellations and refunds for trips resulting from:

8. VACATION REFUND

The INSURER will reimburse the INSURED, up to the maximum amount set out in the Specific Conditions, and subject to the exclusions mentioned in these General Conditions, the cost of the services, contracted before the start of the trip and upon documentary proof of their cost, which could not be used as a result of the early conclusion of the scheduled trip, which necessarily entails the return of the INSURED to his/her usual place of residence, for any of the following reasons, occurring during the course of the trip:
