GENERAL TERMS AND CONDITIONS

1.- TECHNICAL ORGANIZATION OF THE TRIP.

The technical organization of these trips has been carried out by Ultima Frontera, SL, CICMA nº 1197, C/ Francisco Gervás, 17 – 7º H – Madrid, and with CIF B – 82632944 and registration in the Mercantile Registry of Madrid (volume 15.261 – book 0 – folio 1 – section 8 – page M-255612 – insert 1).

2.- REGISTRATIONS.

Upon formally requesting services, a deposit will be paid based on the product purchased. The remaining amount will be paid before the trip's departure, and the payment schedule will be determined by the terms and conditions of the service providers involved in the trip, such as airlines, hotels, cruise ships, diving centers, etc. The corresponding payment schedule will be communicated in advance.

3.- PRICES.

The prices indicated in the Recommended Experiences and Proposals are indicative. Our prices include all services listed as "included"; any other items not specified in this section will be considered as not included in the price. All prices shown on this website are based on current rates and the corresponding exchange rate, as indicated in the " Price Conditions " section. Prices may be revised due to changes in transportation and accommodation rates, as well as fluctuations in the exchange rate of the currency used. If the price increase exceeds 8% of the total price of the package tour, the provisions of sections 2 to 5 of Article 159 of Royal Legislative Decree 1/2007, of November 16, will apply.

4.- CANCELLATIONS AND REFUNDS.

At any time, the client may withdraw from the services requested or contracted, and is entitled to a refund of any amounts paid, whether the total price or the amounts deposited at the time of registration. However, the client must compensate the agency for the following:

a.- Management and cancellation costs, duly justified.
b.- A penalty of 5% of the total trip amount if the cancellation occurs more than 10 and less than 15 days before the trip start date. The penalty is 10% between days 3 and 10. The penalty is 15% within 48 hours prior to departure. Failure to show up at the scheduled departure time will result in no refund of any amounts paid.

Due to the unique nature of this type of travel, most of our products have very different cancellation conditions. We recommend requesting this information in advance or at the time of booking.

5.- CANCELLATION AND MODIFICATIONS OF THE AGREED CONDITIONS.

The agency may only cancel contracted services or modify the agreed terms and conditions due to force majeure or sufficient cause. Sufficient cause is:

  • Cases in which, acting with due diligence, the agency is unable to provide the contracted services for reasons beyond its control.
  • When organized trips do not reach the sufficient number of participants established in the travel conditions and the agency notifies the clients at least 10 days before the departure date.

6.- RISKS.

A large part of Ultima Frontera, SL's programs are geared towards recreational diving (technical diving in certain programs) or outdoor activities involving close encounters with wildlife. We assume that each client has received appropriate training and holds the necessary certifications (in the case of diving) for the safe practice of this activity. In many cases, these trips have a strong adventure component, with a higher risk than usual since they take place outside traditional tourist routes and sometimes involve direct contact with potentially dangerous animals in their natural habitat. The location of some destinations requires the use of unconventional means of transport or booking flights with airlines listed under European Union regulations.

Itineraries and programs may also be modified due to force majeure. For programs that include diving, the dive sites, number of dives, or the cruise itinerary are always at the discretion of the boat captain or divemaster responsible for the operation, depending on sea conditions, weather forecasts, technical criteria, or the experience of all participating divers. For programs that involve observing terrestrial wildlife or interacting with more primitive ethnic groups, these activities may be modified by intervention of local authorities or by decision of those responsible for the National Park or Nature Reserve.

Each client is aware of these circumstances and therefore assumes these risks and obligations with full knowledge of the facts. They agree not to attempt to assign liability for any accidents to Ultima Frontera, SL or the various service providers.

7.- RESPONSIBILITIES.

Ultima Frontera, SL shall be liable to the client for the proper fulfillment of the obligations arising from the contract, regardless of whether these obligations must be fulfilled by the Agency itself or by other service providers, and without prejudice to the Agency's right to take action against said service providers, always within the limits established in these General Conditions and applicable law. In the event of any failure to execute the services, the client must notify the service provider and Ultima Frontera, SL in a reliable manner and as soon as possible, preferably in person or in any case within five days of the end of the trip. For any claim, the client must comply with the provisions of the law. Under no circumstances will Ultima Frontera, SL be liable for accommodation, food, transportation, and other expenses arising from delays in departures or returns by means of transport due to weather, technical reasons, strikes, or other force majeure.

8.- GUARANTEE SOCIETY.

The user is informed that the guaranteeing company that covers the risks of contractual liability and guarantee against insolvency of policy 82464664 is AXA, Seguros Generales, Sociedad Anónima de Seguros y Reaseguros, with registered office at Calle Monseñor Palmer, 1 in Palma de Mallorca and assistance telephone number 91 111 95 43 or 91 571 25 94.

9.- PERSONAL DATA.

In accordance with the provisions of the Personal Data Protection Act, we inform you that the data collected will be incorporated into a file under the responsibility of Ultima Frontera SL for the purpose of fulfilling the obligations arising from our relationship with you. We also inform you that you may exercise your rights of access, cancellation, rectification, and objection by writing to us at: Francisco Gervás, 17 – 7ºH 28020, Madrid (Spain). Unless you inform us otherwise, we will assume that your data has not been modified and that we have your consent to use it for the purpose of maintaining our contractual relationship. We also request your consent to share your data with other companies (such as airlines, hotels, etc.) when this sharing is necessary for the execution of this contract or may improve the relationship between both parties, as well as to be able to send you promotional or advertising information that we believe may be of interest to you, to the postal address you have provided.

PRICING CONDITIONS

All fares indicated are indicative, quoted at a US dollar exchange rate of €0,87, and based on double occupancy (unless otherwise indicated or due to typographical errors). The prices indicated on this website were updated on May 17, 2024. Airfares applied, if shown as included, are in economy class and in the lowest-cost class; therefore, the final price of the trip may be subject to availability of said fare for the requested travel date. These prices are subject to change without prior notice. Please request detailed information about your chosen destination.

The programs and their prices appearing on this website are purely indicative, as the final itinerary may change depending on the departure date, the airline selected, the flight frequency established by the airlines operating in the destination, changes in regulations in the destination or transit country, etc. Many of the destinations we offer are located off the beaten track, and this means that at certain times of the year, access by air or sea may be significantly limited due to the operations of these transport companies. For more detailed information, please contact our reservations department.

As a result of constant fluctuations in oil prices, some shipping companies and airlines may suddenly introduce fuel surcharges, and some cruise ships even require these surcharges to be paid onboard. This is also the case with certain local taxes, port fees, or entry fees to marine reserves. This can represent a significant expense in your travel budget, so we recommend checking the approximate amounts of these fees and whether they apply in advance.

Most of our Underwater Experiences require recreational diving, and in some cases, technical diving. To participate and participate in these activities, it is essential to have an internationally recognized diving certification. Likewise, to use Nitrox, Trimix, Oxygen, or perform certain dives, an appropriate complementary certification is required. Supplements for the use of these gases or obtaining certifications are not included in these prices, nor is diving equipment, except for tanks and weights, unless otherwise indicated. The dives included in the programs do not necessarily include all the dive sites described on this website or indicated on the maps for that destination. Some of the areas described are very extensive, and in order to visit all the dive sites, it may be necessary to complete several combined itineraries. For more exact information on the dive sites planned for a specific program, please contact our reservations department. Despite the above, an itinerary may be modified due to force majeure. The dive sites, number of dives, and cruise itinerary are always at the discretion of the boat captain or divemaster responsible for the diving operation, depending on sea conditions, weather forecasts, or the experience of all participating divers.
